SUBJECT: District Agreement/Articles of Incorporation

Articles of Incorporation are not on file with the state for the Oyster River Cooperative School District as the district was formed prior to law requiring same.

From documentation within archive files at the district office we have been able to verify the following:

Published in local papers of the three communities in July 1953 was the following notice for the State Board of Education by Hilton C. Buley, Commissioner of Education:

As a result of the vote taken by the Durham, Lee and Madbury School Districts, and pursuant to the provisions of Chapter 199 of the Laws of 1947, as amended, the area comprising the School Districts of Durham, Lee, and Madbury is hereby laid out as an elementary and secondary cooperative school district, grades kindergarten through twelve, and is designated as the Oyster River Cooperative School District, No. 2 Cooperative School District of New Hampshire.
Your district is now authorized to proceed in organizing a Cooperative School District, namely, voting approval of the Oyster River Cooperative School District as laid out by the order of the State Board of Education.

At a special meeting on August 6, 1953, the warrant dealing with the organization of the cooperative district read as follows:

To see if the district will vote to adopt the following resolution and pass any vote relating thereto: Resolved that the Oyster River Cooperative School Districts of the towns of Durham, Lee, and Madbury be established to provide for the educational needs and services of all elementary and secondary school children of the aforesaid school districts of Durham, Lee and Madbury, New Hampshire, and that its date of establishment be effective as of July 1, 1954.

The vote on the above warrant as reported in the minutes was as follows:

Total number of ballots casts 207
Necessary to pass 104
For the motion 191
Against the motion 16
The moderator declared the motion carried.

The notice printed in local newspapers referenced the provisions of Chapter 199 of the Laws of 1947, amended. We have no law book dating back to that time. In the file (and attached) seems to be a synopsis of the cooperative school districts law, Chapter 199 of the Laws of 1947 as amended by the Laws of 1951 and the Laws of 1953. This copy has been marked and may be the one utilized by the State Board in authorizing the cooperative.
